The article highlights the international legal foundations for granting asylum to foreigners and stateless persons. It analyzes the peculiarities of the international legal regulation of the status of asylum seekers, the content of the principle of non-refoulement, as well as the role of universal and regional human rights protection mechanisms in the field of international protection. Particular attention is paid to the legal regulation within the framework of the European Union, the case law of the European Court of Human Rights, and their influence on the formation of modern standards for the protection of asylum seekers. It is determined that, despite the absence of a universally established ―right to asylum‖ as an absolute international legal guarantee, the contemporary system of international protection encompasses a set of norms that shape the content and legal regulation of this institution. At the same time, compared to refugee status, the legal status of an asylum seeker is characterized by a lower degree of normative certainty and uniformity in international legal regulation, as well as by the predominance of procedural guarantees over substantive legal ones.
